Terms of Use

These terms are the agreement between you and Iam The Protagonist Ltd, trading as GIFTIT and The It Group ("we", "us"). We are a private limited company registered in England and Wales, company number 16842280, registered office 60 Hay Lane, London, NW9 0NB. Email: theitgroupapps@gmail.com.

By downloading, creating an account on or using GIFTIT (the "app") you agree to these terms and to our Privacy Policy. If you don't agree, don't use the app.

1. What GIFTIT does

GIFTIT helps you remember the people in your life and what to give them: their birthdays and occasions, gift ideas for each of them, reminders before the day, and wishlists you can share. It also lets you plan gifts with other people — Secret Santa draws, chipping in on a gift together, couples sharing hints, and lists you invite others onto.

2. Who can use it

• You must be at least 13 years old.
• If you make an account, the information you give must be true and kept up to date.
• One account per person. You are responsible for everything done through your account, and for keeping your sign-in private. Tell us straight away at theitgroupapps@gmail.com if you think someone else has used it.
• You may not use the app if we have previously closed an account of yours for breaking these terms.

3. Your licence to use the app

We give you a personal, non-transferable, revocable licence to install and use GIFTIT on devices you own or control, for your own private use, under these terms and the rules of the store you got it from. You may not copy, modify, sell, rent, reverse-engineer or redistribute the app, or use it to build a competing product, except where the law says you may. Everything in the app that isn't yours — the design, the code, the name, the logos — belongs to us or our licensors.

4. Things that cost money

One-off purchases

Some features are bought once and kept: the AI gift-ideas unlock, spark packs, and the Secret Santa upgrades. You pay once, and there's nothing further to pay. They're tied to the store account that bought them and can be restored on a new device from inside the app.

Autopilot — an annual subscription

Autopilot costs £9.99 per year in the United Kingdom, including VAT where it applies. The price in your own country is shown in the app before you buy, and that shown price is the one that applies.

For each year you're subscribed, Autopilot watches every occasion for every person on your lists and adds three gift ideas to a person's list fourteen days before each of their occasions, without you asking and without spending a spark.

It renews automatically. Your account is charged for another year within the 24 hours before the current year ends, at the then-current price, unless you turn off auto-renewal at least 24 hours before that. Payment is taken by Apple or Google when you confirm the purchase.

Cancelling. You cancel through the store, not through GIFTIT, in your device's subscription settings. Cancelling stops the next renewal; Autopilot keeps running until the year you've paid for is up. Deleting the app does not cancel the subscription.

Your right to change your mind

If you are a consumer in the UK you have 14 days from purchase to cancel a digital subscription or digital content under the Consumer Contracts Regulations 2013. By starting the service immediately you agree we may begin before that period ends, and that you lose the right to cancel once the content or service has been fully delivered. Where part of it has been delivered you may be charged for that part.

Refunds

In-app purchases go through Apple or Google, and so do refunds — the store handles them under its own rules and we can't issue one directly. Ask the store you bought from. If something genuinely didn't work, write to us and we'll support your request.

Printed star maps

The star-map poster is a physical product. You pay for it through Stripe, and it is printed and posted by our print partner, Printful. The price, including delivery, is shown before you pay. Because each poster is made to your own design, the 14-day right to cancel does not apply once it has gone to print; if it arrives damaged or wrong, tell us within 14 days with a photo and we'll replace or refund it. Delivery times are estimates.

Prices changing

Prices can change. If the subscription price goes up, you'll be told before it takes effect and asked to agree, as the store requires; the new price applies from your next renewal. If you don't agree, the subscription simply doesn't renew. Nothing in these terms affects your statutory rights.

5. Your content and how people treat each other

Everything you put into GIFTIT — people, gift ideas, notes, photos, wishlists, messages — stays yours. You give us a worldwide, royalty-free licence to store, display, copy and transmit it so the app can work, and to show it to the people you've chosen to share it with: someone you've invited to a list, the members of a Secret Santa or chip-in you've joined, your partner in Couples, or anyone you send your wishlist link to. We don't sell your content and don't use it for advertising.

A lot of what you enter is about other people — their birthdays, their sizes, your notes about them. You're responsible for that being reasonable to hold. Only add what you'd be comfortable keeping in a notebook. You promise that what you share is yours to share, doesn't break the law, and doesn't infringe anyone's rights or privacy.

Zero tolerance. No abuse, harassment, hate, threats, sexual content involving anyone under 18, impersonation, spam, scams, or anything illegal — in a wishlist, a Secret Santa message, a chip-in note or anywhere else. We may remove content and suspend or close accounts without notice for any of this.

Reporting. You can remove anyone from a list you own at any time. To report someone or something they've shared, email theitgroupapps@gmail.com; we act on reports within 24 hours and remove content that breaks these rules. We don't pre-screen everything and aren't responsible for what other users share.

Chipping in. A chip-in tracks who has promised what towards a shared gift. No money moves through GIFTIT: the organiser's payment note is their own words, and paying them is between you and them.

6. Gift ideas written by AI

When you ask for ideas, the details of that one person are sent to Anthropic's Claude, which writes suggestions back. They're suggestions, nothing more — they can be wrong, unavailable, or badly judged for the person in question. Check anything before you spend money on it. Prices and links shown for a shop's product come from that shop, not from us, and can be out of date.

7. Acceptable use

Don't: break the law; interfere with the app or anyone else's use of it; probe or overload our systems or try to reach data that isn't yours; scrape or harvest data; use bots; bypass any security or payment; or use the app for anything it isn't for. We may suspend or close accounts that do.

8. Third-party services

The app uses services we don't control — Apple and Google for sign-in, notifications and billing; Supabase for hosting; Anthropic for gift ideas; Stripe and Printful for printed posters; Brevo for email. Each has its own terms, and we aren't responsible for them. Links out of the app, including shop links on gift ideas and wishlists, go to sites we don't run.

9. Availability and changes

GIFTIT is provided "as is" and "as available". We work to keep it running but don't promise it will be uninterrupted or error-free, and we may change, pause or withdraw any feature. If we withdraw the app entirely we'll give reasonable notice. Your own copy of your data lives on your device; a backup depends on services outside our control.

10. Our liability — read this one

• Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else UK law doesn't let us limit.
• If you are a consumer, we're responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that wasn't foreseeable, or for business losses — GIFTIT is for personal use.
• Beyond that, and to the extent the law allows, we are not liable for indirect or consequential loss, lost data, lost profits, or loss caused by things outside our reasonable control, and our total liability to you for any claim is limited to the greater of £100 and what you paid us in the twelve months before the claim arose.
• Your statutory rights as a consumer under the Consumer Rights Act 2015 are not affected.

11. Ending things

You can stop using GIFTIT at any time and delete your account in the app — open the You tab and choose Delete account — or by emailing us. Deleting it removes your data as described in the Privacy Policy.

We can suspend or close your account if you break these terms, if the law requires it, or if we withdraw the app. Where fair, we'll tell you why. Any unused subscription time is dealt with under the store's refund rules. Sections that by their nature should survive — content licences for things already shared, liability, governing law — keep applying after your account closes.

12. Apple and Google

If you downloaded GIFTIT from the App Store: these terms are between you and us, not Apple; Apple has no obligation to support or maintain the app; if the app fails to meet a warranty you may tell Apple, who may refund the price you paid, and beyond that Apple has no warranty obligation; Apple is not responsible for any claim relating to the app or your use of it; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you aren't in a country under a US government embargo and aren't on any US government list of prohibited parties. If you downloaded it from Google Play, Google's own terms also apply to the download and to anything you buy through Google.

13. Changes to these terms

We may update these terms. The effective date at the top changes when we do, and for anything that materially affects you we'll tell you in the app or by email at least 14 days before it takes effect. Using the app after that date means you accept the new terms; if you don't, stop using the app and cancel any subscription.

14. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings there, and nothing here takes away protections you have under the law of where you live. If you have a complaint, email theitgroupapps@gmail.com first and we'll try to sort it out within 14 days. UK consumers can also use the dispute resolution options the Citizens Advice consumer service points to.

15. Everything else

These terms and the Privacy Policy are the whole agreement between us about the app. If any part is found unenforceable the rest still applies. We may transfer our rights under these terms to another company in a sale or reorganisation; you may not transfer yours. Not enforcing a term once doesn't mean we've given it up.

16. Copyright complaints

If you think something in GIFTIT infringes your copyright, tell our designated copyright agent:

Reporting it. Your notice needs: your signature (typed is fine); the work you say is being infringed; where the infringing material is in the app, in enough detail for us to find it; your name, address, phone and email; a statement that you believe in good faith the use isn't authorised by the owner, their agent or the law; and a statement, under penalty of perjury, that the notice is accurate and that you own the copyright or are authorised to act for the owner.

If we removed your content by mistake. You can send a counter-notice to the same agent, saying what was removed, where it was, and why you believe it was removed in error.

Repeat infringers. Accounts that repeatedly infringe other people's copyright will be closed.
